In a pivotal step toward justice, the Collective for the Defense of Banyamulenge, Tutsi, and Hema Victims in the Democratic Republic of Congo has officially lodged complaints with both national and international judicial authorities. This action, revealed in a press release, highlights the Collective’s continued commitment to confronting the violence and human rights abuses endured by these communities in the DRC.
On 6 September 2024, complaints were submitted to the Prosecutor General and the Military Auditor in Goma, as well as to the Prosecutor General and Auditor General in Kinshasa. Simultaneously, a complaint was lodged with the Prosecutor of the International Criminal Court (ICC) in The Hague, Netherlands.
For security reasons, the handling of these complaints has been entrusted to two lawyers, Maître Bernard Maingain and Maître Jean-Paul Shaka, both members of the Collective. This decision follows severe threats made against the Collective’s legal team after the initial filing of the complaints in Goma. The press release states: “Due to the threats faced by the Collective’s lawyers in the Democratic Republic of Congo, SHAKA and MAINGAIN are now managing the case.”
The Collective has provided a comprehensive set of documents to the ICC’s Office of the Prosecutor, including 22 formal complaints with legal representation mandates signed by members of the Banyamulenge community. In addition, the submission includes 218 complaints from Tutsi refugees, 148 complaints from survivors of massacres and atrocities in Masisi, and 257 complaints from Tutsi victims residing in refugee camps.
The Collective also notes that more plaintiffs are expected to join this growing legal effort. However, for security reasons, the identities of the plaintiffs have not yet been disclosed to the judicial authorities.
The ultimate goal of this legal initiative is to secure justice and acknowledgment for the victims by shedding light on the grave violations that have occurred and urging the judicial system to respond appropriately.
